Terms of Use
How this website works, and what you can expect from us.
Welcome to ELCC & Community Development. These terms set out how this website works and what you can expect from us. Please read them — they matter, and we have written them to be readable.
By using this website, you agree to these terms.
1. What this website is
ELCC & Community Development is an information hub for early learning educators, operators and families across Canada. We collect publicly available information about professional learning, funding, research and sector developments, organise it in one place, and link back to the organisation that published it.
We are a signpost, not a source. When you follow a link, you leave this website and deal with that organisation directly, on their terms.
This website is operated by 1533948 Alberta Corp, carrying on business as TOPP KIDS Out of School Clubs / ELCC & Community Development, 425 78 Avenue SW, Calgary, Alberta T2V 5K5, Canada.
2. This is information, not advice
The information on this website is general information about the early learning sector. It is not professional, legal, employment, regulatory, financial or child care licensing advice, and it is not a substitute for advice from a qualified professional or from your own regulator.
Requirements differ between provinces and territories and change over time. You are responsible for confirming what applies to you, in your jurisdiction, before you act. Please do not rely on this website as the basis for a decision affecting a child, an employee, a licence or a legal obligation.
3. We do not issue certificates or credentials to the public
This website does not offer certificates, credentials, accreditation or professional development credit to the public.
Where completion records or certificates are mentioned in connection with TOPP KIDS training, those are internal employment records for TOPP KIDS staff only. They are not accredited, they are not recognised by any governing or industry body, and they do not count toward any teacher qualification, early childhood educator certification level, college registration, or continuing professional learning requirement.
If a program listed on this website offers a certificate, that certificate comes from the organisation running it — not from us. Ask them what it means.
4. Third-party information, links and listings
Listings, resources, statistics and news items on this website describe information published by other organisations. We link to the original so you can read it in full.
We do not control third-party websites or what they contain, and we do not verify, endorse, warrant or take responsibility for the accuracy, currency, completeness, availability, quality, pricing, safety or suitability of anything a third party publishes, offers or delivers. Any dealing you have with them — including registering or paying for something — is between you and them.
Third-party names, logos and trade marks belong to their owners and are used to identify the organisation being referred to. Their appearance does not imply any affiliation, partnership, endorsement or approval in either direction.
5. Accuracy and currency
We take reasonable care, but the sector changes constantly. We do not warrant that anything on this website is accurate, current or complete, and we may change or remove content at any time without notice.
If you spot something wrong or out of date, please tell us. We would rather know.
6. Sponsorship
This website is supported in part by sponsors. Sponsorship supports the operation of the website itself. It does not buy a listing, influence what we include or exclude, or amount to an endorsement of the sponsor by us or of us by the sponsor. Sponsor branding is identified as such wherever it appears.
7. Our content, and yours
Content we create — page text, guides, and materials identified as ours — belongs to TOPP KIDS. You are welcome to read it, print it and share links to it for your own professional use. Please do not republish it, resell it, or present it as your own without our written permission.
If you send us a suggestion, resource or listing, you confirm that you have the right to send it and to let us publish it, and you give us permission to use, edit and publish it in connection with this website. We are not obliged to publish anything, and we may remove anything at any time.
8. Limitation of liability
To the maximum extent permitted by law:
This website and everything on it is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.
We are not liable for any loss or damage arising out of or connected with your use of, or inability to use, this website or anything you obtain through it — including indirect, incidental, special, consequential, exemplary or punitive damages, or loss of profit, revenue, data, goodwill or business opportunity — even if we have been advised of the possibility.
Where liability cannot lawfully be excluded, our total liability to you for all claims is limited to the greater of the amount you paid us in the twelve months before the claim arose, or CAD $100.
Nothing in these terms excludes or limits any right or remedy you have that cannot be excluded or limited under applicable Canadian law, including under consumer protection legislation in your province or territory.
9. Indemnity
You agree to indemnify and hold harmless 1533948 Alberta Corp, carrying on business as TOPP KIDS Out of School Clubs / ELCC & Community Development, and its directors, officers, employees and contractors from any claim, demand, loss, liability, cost or expense — including reasonable legal fees — arising out of or connected with your use of this website or anything you obtain through it, your breach of these terms, your infringement of any other person’s rights, or any content you submit to us.
10. Privacy
How we handle personal information is set out in our Privacy Policy, which forms part of these terms. We handle personal information in accordance with Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and Alberta’s Personal Information Protection Act (PIPA).
11. Accessibility
We want this website to work for everyone. If you encounter a barrier, please tell us — see our Accessibility page.
12. Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. You agree to the non-exclusive jurisdiction of the courts of Alberta.
This does not deprive you of the protection of the consumer protection laws of the province or territory where you live.
13. Changes
We may update these terms. The version on this page is the one that applies, and the date at the top tells you when it last changed.
